Swiss framework conditions
What applies to using AI in a business in Switzerland?
As of August 2026 Switzerland has no cross-cutting AI act: on 12 February 2025 the Federal Council opted for sectoral adjustments, with a consultation draft to be prepared by the end of 2026. Existing law therefore governs — above all the FADP, which expressly regulates automated individual decisions with significant effects (Art. 21 FADP).

Cantonal differences
Cantonal administrations are not subject to the federal FADP but to the respective cantonal data-protection act — in the Canton of Zurich, the IDG. Anyone delivering an AI solution to a cantonal or municipal body checks the cantonal basis, not the federal one.
