Swiss framework conditions
What applies to brands and design in Switzerland?
In Switzerland trademark protection arises only upon entry in the trademark register at the Swiss Federal Institute of Intellectual Property (TmPA, SR 232.11). Copyright in a design, by contrast, arises without any registration, upon creation of the work (CopA, SR 231.1) – the two rights work in opposite ways.

What is different in Switzerland
The indication of source “Switzerland” and the Swiss cross are regulated separately in the TmPA (“Swissness”): for services, only a business with its seat in Switzerland that is actually administered from here may use it.
