A software project with a defined deliverable is legally a contract for work under Art. 363 CO — what is owed is the working product, not the effort. Where the engagement runs as ongoing support without a defined deliverable, it is a mandate under Art. 394 CO, which may be revoked at any time.

Cantonal differences

If the software is delivered to a cantonal or municipal body, cantonal data-protection law applies rather than the federal FADP — in the Canton of Zurich the IDG, with its own supervisory authority. That changes reporting channels and data-subject rights, not merely the name of the act.
